Court order for tenants with unkempt garden

Riverside has obtained a court order against residents in Langley who breached their tenancy agreement by failing to maintain their garden.

Manchester County Court granted the injunction order in 2015 after the unkempt garden was picked up during a routine neighbourhood inspection.

Despite a series of letters and visits to the residents, complaints from neighbours and a warning from our solicitor that a court application would be made, the residents failed to take any action to improve its condition.

The court ordered that the residents must bring their gardens into a clean and tidy condition, free of any rubbish and debris, within 28 days and then maintain the garden in a good condition. The order remains in force for as long as they remain the tenants of the property.

Since the start of 2015, Housing Officer Lee Howarth has successfully applied for two court orders in relation to breach of tenancy agreement and anti-social behaviour.

He said: “We want to work with residents and communities to create vibrant, successful and thriving neighbourhoods.

“We will not hesitate to take legal action where residents fail to adhere to their tenancy agreement, especially where there is an impact on the wider neighbourhood and community.”
